1. Applicability and Acceptance

By accessing our website and/or placing an order, you agree to be bound by these Terms of Service, as well as our Refund Policy, Shipping Policy, Privacy Policy, and Cookie Policy. If you do not agree to all the terms and conditions outlined herein, you may not access the website or use our services.

2. Product Information, Pricing, and Errors

• Accuracy: We endeavor to display and describe our apparel, sizes, and colors as accurately as possible. However, actual colors may vary slightly depending on your computer monitor or mobile screen settings.

• Pricing and Inaccuracies: We reserve the right to correct any typographical errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice (including after you have submitted your order). In the event of a pricing error, we are not obligated to fulfill the order at the incorrect price.

3. Orders and Payment

• Order Processing: All orders are subject to acceptance and availability. An order is only officially processed once full and successful payment has been received.

• Payment Methods: We accept major credit cards and integrated digital payment providers supported by our checkout system (such as Shopify Payments). Available payment methods may vary depending on your location. It is the customer's responsibility to verify that their billing information matches their payment method.

4. Fulfillment, International Shipping, and Customs Duties

• Processing Time (Dispatch): Orders generally require 1 to 3 business days to be processed, packed, and dispatched from our fulfillment hubs.

• Shipping Window: Estimated shipping times typically range from 1 to 7 business days (or longer for specific remote regions) following the dispatch date.

• Global Supply Chain & Import Notice: To ensure accessible boutique pricing and eliminate overhead waste, items are dispatched directly from our network of international manufacturing partners and premium suppliers located across North America, Europe, and Asia.

• Duties and Taxes: Because shipments may cross international borders to reach Canada, shipments may be subject to import duties, customs clearance fees, and local taxes (GST/HST). The customer is recognized as the importer of record and is solely responsible for paying any additional international customs fees.

• Delays: All stated delivery timelines are estimates. Wilson & Calgary Label is not liable for transport delays caused by high seasonal volume, regional holidays, or customs clearance procedures. Such delays do not grant the right to order cancellation or an immediate refund.

5. Returns, Cancellations, and Chargeback Restrictions

• Return Policy: All eligible returns are governed strictly by our separate Refund & Return Policy.

• Cancellation Restrictions: Once an order is placed and enters our automated processing system, it cannot be altered or canceled. If you no longer wish to keep the item, you must receive the shipment first and initiate a standard return.

• Payment Disputes (Chargebacks): Customers agree not to open a chargeback or payment dispute with their bank or credit card company prior to contacting our support team or before the estimated shipping window has passed. Unauthorized chargebacks violate these terms and this document will be utilized as binding evidence to challenge the dispute.

6. Liability and Missing Shipments

• Address Accuracy: It is the customer's sole responsibility to ensure that all shipping information is entered accurately at checkout. Address corrections must be submitted within 24 hours of ordering via info@wilsoncalgarylabel.com.

• Carrier Delivery: Wilson & Calgary Label is not responsible for lost, delayed, or stolen packages if the official carrier tracking info denotes that the package was successfully delivered to the address provided.

• Limitation of Liability: To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or in connection with the purchase of products shall be strictly limited to the total purchase price of the specific product in question.

7. Intellectual Property

All content included on this website, such as text, product imagery, graphics, logos, button icons, and overall digital design, is the exclusive intellectual property of Wilson & Calgary Label. Any unauthorized duplication, reproduction, or use of these materials without explicit written consent is strictly prohibited.

8. Complaints and Customer Support

We value your feedback and aim to resolve any issues quickly and amicably. If you have a complaint regarding item quality, sizing, or service:

• We strive to respond to all inquiries within 5 business days.

• For complaints regarding defects or incorrect sizes, you must attach high-resolution photos and a clear description of the issue to your email.

9. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services shall be governed by, construed, and enforced in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these terms shall be resolved exclusively within the competent courts located in Calgary, Alberta, Canada.
